Can a one party of a divorce deduct temporary spousal maintainence on tax return?
If a court ordered a spouse to pay the mortgage, the car payment, the utilitiy bills etc. for the other spouse during a long (20+ months) divorce proceeding, how can the spouse that is NOT paying the bills cover themself legally so the other spouse doesn't have the ability to claim these payments as alimony (temp. spousal maintainence, etc) which would cause the other to claim on tax return. Both spouses have agreed to NO maintainence...but I believe this applies to after the decree. My question pertains to maintainence during the proceedings. Thanks
